Intellectual property law is increasingly important

Term "intellectual property law" encompasses the various areas of law that serve to protect and regulate the use of so-called intellectual property. Anything that is created by humans using reason and that is new and previously unheard of can be considered as intellectual property. The definition of intellectual property includes song lyrics, poems, prose, music, photography, trademarks, works of art or patents. In individual countries, intellectual property rights also include trade secrets (for example, in the United States).

The basic assumption protection of intellectual property rights is to apply rules that serve "promoting progress", which is explained by the fact that through the exchange of intellectual property rights, their owners reap profits, which in turn inspire others, and this in a straightforward line contributes to the development of societies and their progress.

What is the scope of intellectual property protection?

This scope depends directly on the type of intellectual property. Copyrighted works are protected from the moment they are created and do not need to be registered. On the other hand, all inventions, as objects of industrial property, must be filed with the relevant patent office, where they receive the appropriate documents confirming legal protection.

In Poland, this type of protection is dealt with by Patent Office of the Republic of Poland. Protection of the assets it covers applies only within our own country. Protection in other countries is the responsibility of the authorities there, to which separate applications must be made.

What basic acts govern intellectual property law?

The protection of individual property rights in Poland derives from the regulations described in the property law and the law of obligations. The protection of intellectual property also has references to the law of inheritance. The basic legal acts regulating the protection of intellectual property are:

  • Copyright and Related Rights Act,
  • Data Protection Act,
  • Act on Combating Unfair Competition,
  • Civil Code,
  • Industrial Property Law.


Following Poland's accession to the European Union, more and more attention is being paid to the protection of intellectual property every year. This is demanded by creators and inventors themselves, because the more their rights are protected, the greater the profits they can make from them.
