With the aim of protecting the borrower's rights, we act taking into account both our client's expectations and the possibilities under the contract. Usually two options are available:

  • cancellation of the (denominated) loan - the court orders the bank to return the instalments paid (this also applies to any additional charges, for example, margin and commission) and the client to return the amount of the debt taken out;
  • "de-franking" the (index-linked) loan - in this situation, the court, having identified the illicit provisions in the contract, orders the amendment of the contract and the switch to further repayment of the debt in PLN (this way helps to recover up to 30-70% of the value of the loan).


The judgment of the court of first instance may be appealed to the court of second instance and, at the level of a final decision, there is an option to apply for a cassation to the Supreme Court. We represent our clients at all of the above-mentioned stages of the court case and also provide substantive legal advice.

Until recently, all cases went to court because the banks were sure of winning, but nowadays they are increasingly losing. It is not uncommon for proceedings to end already at the pre-litigation stage, so it is advisable to take professional advice from an experienced lawyer or solicitor. Below is the full process for helping francophiles:

  • Pre-judicial stage - involves seeking a settlement with the bank; to this end:
  • we seek to invalidate the contract in whole or in part (in the case of the presence of prohibited clauses);
  • we file a request for a settlement with the court, thus interrupting the running of the statute of limitations (many of the documents we deal with were signed at least 10 years ago - you can also assert your rights in this situation);
  • we file a complaint on behalf of the client with the lending bank and, once we have received a response, we can file a request for an opinion with the Financial Ombudsman (while preparing for the process);
  • Litigation stage - occurs if the case goes to court due to a lack of agreement; in this case:
  • we calculate the amount of the claim against the bank;
  • we send a statement of claim to the court in the town where the bank's head office is located or in the town where the loan was taken out;
  • we represent the client in court.


All of the above activities carried out within the framework of assisting francophiles are aimed at obtaining adequate compensation and also at avoiding further difficulties associated with the repayment of debts over many years. In the case of a more complicated life situation, we can also propose other solutions to the client, such as declaring consumer bankruptcy.
