Protection of intellectual property
The human mind has the capacity to create intangible goods, which are classified as so-called intellectual property. These creations of reason and imagination, although intangible, are usually recorded on tangible media, which allows them to be named, preserved and protected.
It is impossible to define precisely all the elements subject to such protection, as human imagination is practically limitless and it may turn out that what has so far not been subject to any classification but has all the predispositions to be legally protected will emerge as intellectual property. Most often, however, intellectual property is contained in areas such as art, science, literature and industry.
To adequately protect intellectual propertyThe protection of the public should be based on a broad knowledge of the legal fields pertaining to this protection. In Poland, four basic legal acts serve this purpose. These are:
1. Copyright and Related Rights Act of 4 February 1994.,
2. Act on Combating Unfair Competition of 16 April 1993.,
3. Law on Protection of Databases of 27 July 2001.,
4. and Industrial Property Law of 30 June 2000.
In order to properly protect works created in the privacy of painters' studios, recording studios or saved on the computer disks of creators, the Copyright and Related Rights Act was introduced. It watches over the legal security of works recorded with words, notes, graphic or mathematical symbols. It covers areas such as visual arts, photography, performing arts, music, dance and audiovisual arts, urban planning, architecture, violin-making and industrial design.
According to the Act on Copyright and Related Rights "the subject matter of copyright shall be any manifestation of creative activity of an individual character, established in any form, irrespective of value, purpose and manner of expression".
Under this law, inventions, trademarks and utility models are protected. Each of these elements is precisely defined in the law, and compliance with the provisions contained therein guarantees effective legal protection of the resulting work.
